Advertising hotels on Instagram* — is that it? We tell you about the signs of advertising and fines.
Facebook Instagram*, Facebook*, and X. Starting from September 1, 2025, according to Federal Law No. 72 of 04/07/2025, it is prohibited to publish and promote ads on online resources to which the authorities have restricted access. [formerly Twitter].

Telegram, despite the fact that calls through it have been restricted, is not subject to the law.

What can no longer be posted on banned social networks:
  • paid advertising [target, promo posts];
  • advertising integrations and collaborations, including on barter terms;
  • any other information that the FAS [Federal Antimonopoly Service] may consider advertising.
How do I distinguish ads from non-ads?

Advertising is "information disseminated in any way, in any form and using any means, addressed to an indefinite circle of people and aimed at attracting attention to the advertised object, forming or maintaining interest in it and promoting it on the market." 

It sounds vague, but in fact, the FAS, which will decide the fate of the publication, looks at more specific signs of a "focus on attracting attention."

Signs of advertising:
  • addressing an unspecified group of people: the information is not addressed to a specific person, but to many — even if it is only your subscribers or mailing list base.; 
  • excessive emotional presentation with an emphasis on the benefits of the product, rather than on personal opinion;
  • drawing attention to a particular product/service — obviously, the material promotes a particular hotel, tour, or brunch;
  • The commercial nature of the message: it's not about paying for a post, but about the fact that its purpose is to stimulate sales.;
  • something else that can increase brand or product awareness, such as a call to action, a promise of benefits, promotion terms, and even order contacts. 
What is not considered advertising?

Everything that the FAS does not consider advertising refers to information. For example, a story about yourself and your projects, neutral facts about a hotel or tour, selections without special accents, reviews with personal opinions, and organic integrations that do not promote a specific brand.

Fines: who can be punished and for what?

Both the account owner and the advertiser are responsible for the violation. Sanctions for publishing advertisements on prohibited resources are prescribed in Article 14.3 of the Administrative Code of the Russian Federation.:
  • individuals and the self—employed - from 2 thousand to 2.5 thousand rubles;
  • individual entrepreneurs and officials — from 4 thousand to 20 thousand rubles;
  • organizations (legal entities) — from 100 thousand to 500 thousand rubles. 
What should I do with the old ad?

Ads published before September 1 fall under the general rule that the law is not retroactive, although Roskomnadzor tried to state the opposite. FAS experts have confirmed that the ban does not apply to old advertisements if they are not distributed and mentioned after the X date. 

However, you need to be careful: old ads can "come to life" and bring a fine if you fix them, repost them, or promote them in some other way, even if you just refer to them. And the algorithms of social networks carry a risk: for example, if someone likes an old advertising post, it may reappear in the recommendations even without the author's initiative - and a fine is possible. 

What is still allowed?

Facebook Instagram*/Facebook* and other social media accounts with limited access are not prohibited by law. You can also continue to publish non-commercial information there.:
  • information and entertainment content;
  • personal stories, reviews, and opinions;
  • neutral reviews and compilations that don't focus on one brand.;
  • information about your own projects without calls for purchase. 

To understand which zone you are in, gray or green, ask yourself one simple question.: "Am I trying to sell something right now, or am I just sharing information?" If the post is narrative, you're safe. If it reads: "Buy!", "Subscribe!", "Book!" — this is a risk area.
